Auction Terms and Conditions

  1. The organiser
    The auction is operated by the Hawk and Owl Trust, registered charity number 1058565 (“the Trust”, “we” or “us”). All proceeds from the auction will support the Trust’s charitable work.

  2. Eligibility
    Bidders must be aged 18 or over and legally capable of entering into a binding contract.

  3. Online bidding
    All auction bids must be placed online through the Trust’s designated auction portal. Bids submitted by telephone, email, post or any other method will not be accepted unless the Trust expressly states otherwise.

By placing a bid, you agree to purchase the item if you are the highest bidder when the auction closes. Bids cannot normally be withdrawn unless they were submitted in genuine error and the Trust is notified promptly.

  1. Successful bids and payment
    The highest valid bid received through the Trust’s auction portal before the stated closing time will normally be accepted.

The successful bidder must pay the full amount using the payment method provided and within the period stated on the auction portal. If payment is not received, the Trust may offer the item to another bidder or relist it.

  1. Auction administration
    The Trust may reject a bid, withdraw an item, correct an obvious error, extend an auction or cancel an auction where reasonably necessary. This may include circumstances involving a technical problem, suspected fraudulent activity, an incorrect listing or another issue affecting the fair operation of the auction.

  2. Item descriptions
    Auction items may be donated, pre-owned or handmade. The Trust will take reasonable care to describe and photograph each item accurately and to identify any known damage or defects.

Colours, measurements and appearance may vary slightly from photographs. Nothing in these terms limits the bidder’s statutory rights where an item is faulty or materially misdescribed.

  1. Collection of items
    The successful bidder is responsible for collecting the item from NR21 9GN within 14 days of the auction ending. Collection must be arranged with the Trust in advance.

The successful bidder is responsible for providing suitable transport, packaging and assistance for the safe removal of the item where required.

Unless otherwise agreed in writing, an item not collected within the 14-day period may be offered to another bidder, relisted or otherwise disposed of. Any payment already made may not be refundable where the bidder has failed to collect the item as required, subject to the bidder’s statutory rights.

  1. Cancellation and returns
    Where applicable, consumers purchasing through an online auction may have a statutory right to cancel the contract within 14 days of collecting the item.

To exercise any applicable cancellation right, the successful bidder must contact the Trust and clearly state their decision to cancel.

Unless the item is faulty or materially misdescribed, the bidder will normally be responsible for returning the item to the Trust and for any associated costs. Any statutory exceptions to cancellation rights will continue to apply.

  1. Ownership and risk
    Ownership of an item will not pass to the successful bidder until full payment has been received.

The item will become the successful bidder’s responsibility once it has been collected from the Trust’s premises.

  1. Liability
    The Trust does not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or breach of statutory consumer rights.

Subject to this, the Trust will not be responsible for losses that were not reasonably foreseeable when the contract was formed.

  1. Personal information
    Personal information provided by bidders will be used to administer the auction, process payments, communicate with successful bidders, arrange collection and meet the Trust’s legal obligations.

  1. Governing law
    These terms are governed by the laws of England and Wales.

Consumers may also benefit from mandatory legal protections applicable in the part of the United Kingdom in which they live and may bring proceedings in the courts available to them under applicable law.
